Deputy Minister of Environmental Protection and Agriculture, Ms. Nino Tandilashvili, presented a new draft law on Environmental liability the parliamentary committee session that was prepared within the framework of the Georgia-EU Association Agreement.

,,The primary goal of the draft law is to regulate and prevent damage on environment and to, mitigate its adverse effects the draft Law is fully in compliance with the requirements of the EU Directive on Environmental Liability.

The Ministry has been working on the draft law for several years involving local and international experts. It should also be noted that the draft law sets out completely new approaches in terms of environmental liability. “- Nino Tandilashvili stated.

Under the new regulations, an enterprise that causes significant damage to the environment will be obliged, in agreement with the Ministry, to take appropriate measures to ensure remediation and create solid financial guarantees to eliminate the damage. In case of potential damage, The Company will also be obliged to immediately notify the Department of Environmental Supervision of the Ministry of the expected damage to the environment and take preventive measures to eliminate the threat.

As Nino Tandilashvili underlined at the committee hearing, the key objective of draft law is to ensure the private sector’s high responsibility for environmental protection, to be oriented on the prevention of damage and accumulate financial resources to take measures to restore the damaged environment.

“The new regulations provided by the draft law are based on the principle -” The polluter pays. “Money paid, as the compensation for remediation will be transferred to the designated account and will be used to restore the damaged environment” - stated Nino Tandilashvili.
